U.S. Privacy Addendum

Some U.S. state comprehensive privacy laws (“Privacy Laws”) require us to provide residents additional privacy disclosures and inform them of their rights. This U.S. Specific Disclosure (“U.S. Specific Disclosure”) supplements the Privacy Notice and applies solely to individuals who: (a) reside in California, Nebraska, and Texas.
As used in this U.S. Privacy Addendum, the term “Personal Data” refers to any data relating to an identified or identifiable natural person as defined under the Privacy Laws applicable to you, including various legal terms such as personally identifiable information, PII, or sensitive personal data. Any other capitalized but undefined terms shall have the meanings set forth in the Privacy Notice.
While we strive to manage various Privacy Laws consistently, some terms, obligations, and rights only apply or may be available to those who live in certain jurisdictions. Use of the term “right” in this U.S. Specific Disclosure is not intended to and shall not confer any legal rights or remedies on any person or party, and any such rights or remedies shall only exist to the extent expressly provided under applicable Privacy Laws.
- Data Collection, Purpose, And Source
We recommend you carefully review the Privacy Notice for the types of data we collect and how we use it. In addition, as required under certain Privacy Laws, we identified the categories of personal data we’ve collected, the source, and purpose, including from the last 12 months.

Directly from You. For example, from the forms you complete on our Offerings, preferences you express or provide through our Offerings, or from your purchases on our Offerings.

From Service Providers. For example, third-party vendors to monitor and analyze the use of our Offerings, third-party vendors to provide advertising on our Service, third-party vendors to deliver targeted advertising to you, third-party vendors for payment processing, or other third-party vendors that we use to provide the Offerings to you.
We may also use or disclose the Personal Data we collect for one or more of the following purposes as described in the Privacy Notice:
- Provide Safety and Security.
- Troubleshoot.
- Facilitate Corporate Transactions.
- Obtain Your Consent.
- Comply with Legal Obligations.
- Aggregated or De-identified Data.
We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated, or incompatible purposes without providing you notice.
- Data We Do Not Collect & Inapplicable Use
We do not intentionally collect data on persons under the age of 18 or Sensitive Data as defined under applicable Privacy Laws. If we become aware of the collection of Sensitive Data or data on persons under the age of 18, we will delete it.
We do not use your Personal Data to profile in furtherance of decisions that produce legal or similarly significant effects as defined under applicable Privacy Laws.

In the preceding 12 months, we have disclosed the following categories of Personal Data for a business purpose:

We disclose your Personal Data for a business purpose to the following categories of third parties:

- Other Third Parties, such as our affiliates/subsidiaries.
- Sale Or Use Of Information For Targeted Advertising
Our use of tracking technology, including cookies and related technology, may be considered a sale/sharing under some Privacy Laws.
The categories of Personal Data disclosed that may be considered a sale/sharing include: Identity Data, Customer Records Data, and Internet Use Data.
The categories of third parties to whom Personal Data was disclosed that may be considered a sale/sharing include data analytics providers.
- Rights And Choices Of
Consumers
Applicable Privacy Laws may provide you with specific rights regarding your Personal Data. This section describes your rights and explains how to exercise those rights. Certain requirements must be met for consumers to exercise their rights, see Exercising Rights below for more information on what requirements must be met and how to exercise said rights.
- Opt-Out Rights
for Sale/Share of Your Personal Data
Our use of your Personal Data may be considered a sale/sharing under Privacy Laws. If you would like to opt out of the sale/sharing of your Personal Data, please contact us using the Contact Information section below.
- Access Rights
You have the right to request that we disclose certain information to you about our collection and use of your Personal Data over the past 12 months, including:
- The categories of Personal Data we collected about you.
- The categories of sources for the Personal Data we collected about you.
- Our business or commercial purpose for collecting or selling that Personal Data.
- The categories of third parties with whom we share that Personal Data.
- The specific pieces of Personal Data we collected about you (also called a data portability request).
- If we sold or disclosed your Personal Data for a business purpose, two separate lists disclosing:
- sales, identifying the Personal Data categories that each category of recipient purchased; and
- disclosures for a business purpose, identifying the Personal Data categories that each category of recipient obtained.
Once we receive and confirm your consumer request, we will provide you with the requested information. See Exercising Your Rights for more information.
- Data Correction Rights
You have the right to request that we correct inaccurate Personal Data that we collected from you and retained, taking into account the nature of the Personal Data and the purposes of processing the Personal Data. Once we receive and confirm your consumer request (see Exercising Your Rights for more information.), we will use commercially reasonable efforts to correct the inaccurate Personal Data (and direct our service providers to correct) your Personal Data from our records, unless an exception applies.
- Deletion Rights
You have the right to request that we delete any of your Personal Data that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your consumer request (See Exercising Your Rights for more information), we will delete (and direct our service providers to delete) your Personal Data from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the Personal Data, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
- Exercising Your Rights
Only you, or someone legally authorized to act on your behalf, may make a “verifiable consumer request” (subsequently referred to as a “consumer request”) related to your Personal Data. You may also make a consumer request on behalf of your minor child.
You may only make a consumer request for access or data portability twice within a 12-month period. To be verifiable, a consumer request must include:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized representative and that you have rights under this U.S Privacy Addendum.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you.
Making a consumer request does not require you to create an account with us, but we may require authentication of the consumer that is reasonable in light of the nature of the Personal Data requested.
We will only use Personal Data provided in a consumer request to verify the requestor’s identity or authority to make the request.
- Initial Request Format and Timing
Once received, we endeavor to respond to a consumer request within the allotted time required by law. If we require more time, we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Data that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, to the extent technically feasible.
We do not charge a fee to process or respond to your consumer request unless it is excessive or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
- Appeal Request
Under certain Privacy Laws, you may have a right to appeal our decision regarding your initial consumer request.
If you have a right to appeal, your appeal should be sent to the place where the initial consumer request was sent (see Exercising Rights). The appeal should clearly indicate that it is an appeal of an initial consumer request and should include the initial request along with our response explaining why we cannot comply with the request.
We will answer your request within a reasonable time frame. If we require more time than the initial timeline allowed under the applicable Privacy Laws, and we are allowed to extend our response time under applicable Privacy Laws, we will notify you within the original timeframe letting you know we require more time and reason for the delay.
Once we respond, we will inform you of any action taken or not along with an explanation of the reason in support of the response. If you have any concerns about the results of an appeal, you may have the right to be notified under applicable Privacy Laws that you can submit a complaint to your attorney general. We will provide you with such notification and a link to the attorney general’s website, if applicable.
- Non-Discrimination
We will not discriminate against you for exercising any of your Privacy Laws rights. Unless permitted by Privacy Laws, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
- Other California Privacy Rights
California’s “Shine the Light” law (Civil Code § 1798.83) permits users of the Site that are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. To make such a request, please contact us using the Contact Information below.
- Changes to our U.S. Privacy Addendum
From time to time, we may update this U.S. Privacy Addendum. For any material changes, we will adhere to the same notice requirements set forth in the Privacy Notice. Please review the Privacy Notice for more information.
